KYIV, Ukraine, 5 April 2013 - UNHCR welcomes that Mr. Abdoumalik Abdoulladjanov, a US recognized refugee, is in good health upon his release from detention since February 5, 2013.
The Regional Representation of the United Nations High Commissioner for Refugees encourages the Ukrainian authorities to extend protection to a US recognized refugee who has been detained at Boryspil airport on February 5, 2013, in response to an Interpol red flag. The person is currently being held under temporary arrest while the General Prosecutor’s Office is considering the request for his extradition.
UNHCR welcomes the fact the Ukrainian authorities are continuing their efforts to improve the quality and harmony of legislation in the area of asylum. As the Visa Liberalization Action Plan between the Ukraine and the European Union stipulates that such legislation should meet both international and European standards, UNHCR continues to support the authorities in understanding and applying these standards. In this regard, we note that the Law on amendments to some legislative acts of Ukraine in connection with adoption of the Law of the Law of Ukraine on the Legal Status of Foreigners and Stateless Persons came into power on 15 November 2012.

URGENT ACTION
detained asylum-seekers stop hunger strike
The strike, held in protest by the group of Somali asylum-seekers and migrants, against their illegal detention and alleged ill-treatment, lasted for six weeks. The strike was halted by the group on 17 February after they received assurances from the State Migration Service that their asylum applications would be considered.
UNHCR is relieved to hear that the hunger strikes have ended at both detention centres in the Volyn and Chernigiv regions of Ukraine. The detainees, including many asylum-seekers and minors, were protesting against the length of their detention and demanded that the authorities consider their asylum claims in compliance with international standards.

The Supreme Court of Hungary (Kúria) issued an official opinion on 10 December 2012 in order to promote a harmonised practice at Hungarian courts regarding the application of the safe third country concept in asylum cases. The concrete reason for issuing such a guidance document was that in recent years, different Hungarian regional courts applied different approaches upon reviewing administrative decisions which deny admission to the in-merit asylum procedure based on the fact that the asylum-seeker arrived in Hungary from a safe third country. This also meant a diverging evaluation of the asylum situation in Serbia (the target country of most safe third country returns of asylum-seekers from Hungary).

On August 31, 2012, Social Action Centre made a statement on behalf of the Coalition of NGOs at the pre-session for the UPR in Geneva (see full text of the statement here). Within 10 days that passed since the pre-session, the situation dramatically changed – Ukrainian Parliament adopted the anti-discrimination law. Now this document awaits the President to sign it before it will enter into full force.
The informal coalition of 4 NGOs - Social Action Centre (SAC), Association of Ukrainian Human Rights Monitors on Law-enforcement (UMDPL), Euro-Asian Jewish Congress (EAJC) and The Gay Forum of Ukraine (GFU) got together to prepare the following submission(1). All member participants have a long history of cooperation in past and are expert in the topic of the discrimination in Ukraine. Main goal of this coalition submission is to draw attention to the problem of discrimination in Ukraine. Despite many previous recommendations from treaty bodies, including recommendations received and accepted by Ukraine within first cycle of the Universal Periodic Review, no significant changes were introduced into legal system in Ukraine to effectively ban discrimination and provide protection to victims of discriminatory acts and practices.
